Another Sheffield takeaway fights for right to trade with London Road planning permission concerns
Claims that venue us ‘immune from enforcement and lawful’
Another Sheffield takeaway has launched a bid to secure their right to trade from their shop, amid planning permission concerns.
Shakebees , on London Road, is asking Sheffield Council to provide them with a document to confirm they are allowed to operate, amid concerns that the shop does not have planning permission for a takeaway.

They are trying to prove that the building on 237 London Road, Highfield, has been used as a takeaway for more than 10 years, which would make it immune from enforcement action.
Records show the council turned the building down for planning permission to use the site for the sale of takeaway hot food, in 1990, and then, in 1991, approved its use as a a debt counselling office.
But UH Design Architectural Services say in a statement supporting Shakebees: “This application proceeds on the basis that the change from that office use to a hot food takeaway use was made without permission, but that the use has since continued unbroken for a period exceeding 10 years and is accordingly immune from enforcement and lawful.”
It comes after a pizza takeaway was turned down by Sheffield Council after bosses asked for one of the certificates.
The council’s planning department refused to issue a document called a Certificate of Lawfulness, which would have effectively given Parkway Pizza, at 120 Handsworth Road, assurances that they could keep operating from the site, which is just off the Sheffield Parkway’s Handsworth junction.
