Judges today rejected an appeal made by the Attorney General that a prison term given to Sheffield slave beater David Rooke was too low.
The Court of Appeal refused permission to refer as unduly lenient the sentence of six and a half years given to Rooke for False Imprisonment and Actual Bodily Harm toward Craig Kinsella.
Speaking after the hearing today the Attorney General, Dominic Grieve QC MP said: “This was a shocking case of exploitation on a vulnerable man by a family who abused and assaulted him on a regular basis.
“Mr Kinsella was tricked and trapped by people who posed as his friends and employers In reality they were manipulative and exploited him. He lived in David Rooke’s garage in appalling conditions and the abuse only came to light when the police were called.
“I accept the decision of the Court.”
Between May and July last year, Rooke imprisoned his victim and forced him to work.
During this time Mr Kinsella was subjected to regular beatings; on occasions this would involve the use of weapons such as a pick axe handle.
Such was the level of mistreatment and violence, that the Mr Kinsella was left with broken bones and seriously underweight. The abuse was captured on CCTV footage, which showed the shocking and frequent nature of the abuse, and the inability of the Mr Kinsella to do anything to defend himself.
David Rooke was sentenced together with two co accused: his son, Jamie Rooke, who pleaded guilty to five counts of ABH and one count of affray, and his wife, Donna Rooke, who pleaded guilty to one count of battery. Their offences are not in the Unduly Lenient Sentence Scheme.
David Rooke was found guilty of False Imprisonment and ABH, on the January 7, 2014, at Sheffield Crown Court, he was sentenced by His Honour Judge Kelson Q.C, to six and half years,
comprising two and half years for false imprisonment, and four years for ABH.
That sentence was considered unduly lenient by the Attorney General who referred it to the Court of Appeal and presented the case himself this morning.
