Chesterfield magistrates’ court heard today, Thursday, March 9, how Daniel Brooke, 35, of Sterndale Road, Sheffield, stole a Samsung 49inch TV worth £479 from Tesco Extra, on Lockoford Lane, Chesterfield.

Prosecuting solicitor Lynn Bickley said: “A security guard saw a male pushing a large TV and he walked past the payment point to a travelator and the guard asked for a receipt and he said he was going to a cash machine.

“He was detained for theft and refused to go back into the store and he was shouting and swearing and other members of staff came and detained him.”

Brooke told police he had not gone to the store with the intention of stealing but when he had seen the TV he thought he could get away with it.

He also told the court he had been off work with depression and was struggling for money and he had been on different types of medication and he had been drinking which had affected his judgement.

The defendant pleaded guilty to the theft which happened on February 13.

Brooke’s case had originally been adjourned from a previous hearing on February 28 for a probation report but he failed to return court as requested on March 2.

He told the court he had not been stable and admitted failing to surrender to court for the March 2 hearing but he subsequently handed himself into the police.

Magistrates sentenced Brooke to a six month community order with a Rehabilitation Activity Requirement.

He was also fined £80 and ordered to pay £85 costs and an £85 victim surcharge.
