A GREAT-GRANDFATHER who kept 61 wild birds and 40 others in ‘shocking’ conditions has been spared prison.
Malcolm Spencer, aged 67, pleaded guilty to offences concerning bird welfare - including causing unnecessary suffering and attempted trapping - between last July and September.
Chesterfield magistrates yesterday sentenced him to four months in prison, suspended for two years.
Spencer, of New Bolsover, was ordered to pay £1,800 costs, disqualified from keeping birds for 10 years, and handed a four month curfew order.
RSPCA Insp Carroll Lampbert said the birds were kept in ‘shocking’ conditions.
The court heard there was no evidence Spencer benefited financially. All birds were released or rehomed.
