Chesterfield magistrates’ court heard on Wednesday, December 2, how John Eusman, 66, of Ashley Close, Killamarsh, was also driving the Nissan Micra without a licence or insurance when he collided with a Citroen Picasso in Killamarsh.

Prosecuting solicitor Becky Allsop said: “The other motorist was driving a Citroen Picasso and intended to got to Morrisons at Halfway when he was passing the Midland pub near a roundabout when the Nissan Micra came out of a car park and entered the carriageway and collided with his Picasso.”

The court heard how the Nissan Micra belonged to Eusman’s wife and he called her and said he had been driving and had had an accident and this vehicle was written-off.

Eusman pleaded guilty to taking a vehicle without the consent of the owner and being involved in an accident owing to his driving.

He also pleaded guilty to driving without insurance and a licence after the incident in June.

Eusman claimed the other driver had turned off his indicator and he thought it had been clear to go through but there was a collision.

He added: “My friend usually picks me up and drops me off but my mobility scooter had broken down and it was one of those things. I am sorry.”

Magistrates sentenced Eusman to a 12 month community order with a daily curfew from 7pm to 7am for 12 weeks with electronic monitoring.

Eusman was also banned from driving for 12 months and ordered to pay a £60 victim surcharge, £85 costs and a £150 courts charge.
