South Yorkshire sex-offender gets curfew after breaching order when he went on holiday to Spain

A registered sex-offender who failed to notify South Yorkshire Police before he went on holiday to Spain has been placed on a community order with a curfew.

Sheffield Magistrates’ Court heard on November 13 how Simon Nicholls, aged 48, of All Saints Meadows, Laughton Common, Rotherham, admitted failing to comply with notification requirements in October, 2019, as an offender under the Sexual Offences Act by failing to register his intention to travel outside the UK.

Nicholls also admitted failing to comply with notification requirements by failing to complete his annual registration with police in October and he admitted failing to notify police of a new passport in March, 2019.

Emily King, prosecuting, had previously told the court that police had received notification on October 18, 2019, that Nicholls was in Spain but this should have been completed before he left the UK.

Nicholls had left the UK to travel to Girona, in Spain, on October 14, 2019, and returned on October 21, 2019, according to the court.

Louisa Giblin, defending, said Nicholls had assumed he had more time to register and there was no deliberate attempt to avoid notification.

After considering a probation service report, Nicholls was sentenced to a two-month community order with an eight-week curfew with electronic monitoring running daily between 10.30pm and 7am.

Nicholls, who is a relevant offender within the terms of Section 80 of the Sexual Offences Act 2003, was also orderd to pay £85 costs and a £90 victim surcharge.
