A man wh attacked his former partner’s new boyfriend when he found them in bed together has narrowly been spared from jail.

Jake Deakin, 24, admitted assaulting his ex-partner’s new boyfriend at her home in Barnsley on April 6.

Prosecuting solicitor David Marshall told a Sheffield Magistrates’ Court hearing – sitting at the Sheffield Crown Court building – Deakin had also assaulted his former partner on April 1 after he had been asked to leave her home and had returned and slapped her and put his hands around her throat.

A door frame was also damaged during this incident, according to Mr Marshall.

Mr Marshall said Deakin returned again about 1.30am, on April 6, when his ex-partner was in bed with her new boyfriend.

Deakin pushed his ex-partner out of the way and assaulted her new partner by throwing and punching him, according to Mr Marshall, and by stamping on his legs and one of the blows deflected and struck Deakin’s ex-partner.

The defendant, of Newstead Terrace, Fitzwilliam, Pontefract, pleaded guilty to assaulting his ex-partner and to causing damage on April 1 and he pleaded guilty to assaulting his ex and her new boyfriend on April 6.

John Evans, defending, said Deakin had been struggling with mixed-messages and claims he had injured his ex-partner recklessly while assaulting her new boyfriend and claimed he had damaged a roofing lat and not a door.

Deakin was sentenced this month to 26 weeks of custody suspended for a year with 80 hours of unpaid work and a three-month curfew. He must also pay £300 compensation.
