Crash victim’s widow pursues legal claim

A WOMAN who escaped a jail term after she killed a cyclist in a road smash is being sued for a six- figure sum by her victim’s widow.

Debra Hearn, formerly Kelly, escaped prison because she was pregnant and the judge did not want her to give birth behind bars.

She admitted causing death by careless driving by killing father-of-four Kenneth Lush in 2009.

Hearn now lives on Sheaf Street in Sheffield city centre, but at the time of the crash on the A414 between Hatfield and Hertford she lived in Welwyn Garden City, Hertfordshire. She fled the scene of the smash and later told police she thought she had hit an animal. Now Mr Lush’s widow Cornelia is suing Hearn for negligence.

A writ issued at London’s High Court said Hearn admitted in January 2011 liability for the crash - but the two sides have been unable to agree how much compensation Cornelia Lush should receive. Mr Lush, who ran family business Lush Heat Treatment, lived with his wife and family in Fairway, Ware.

Mrs Lush is seeking more than £300,000 damages for herself and their four children Christine, 13, Renate, 11, twins Philip and Eric, aged six, Mr Lush’s mother Karin, 71, and his brother George, 42.
