Burglar loses appeal over trial verdict

A 52-YEAR-OLD burglar jailed after being spotted carrying a TV down a street has lost an appeal against his conviction.

Franklin Tomlinson, of Emerson Crescent, Parson Cross, was jailed for three years at Sheffield Crown Court in May after being convicted of burglary – but continues to deny it and took his case to London’s Court of Appeal in a bid to overturn his conviction.

Lawyers for Tomlinson, who has two previous burglary convictions, said identification evidence used to finger him was not strong enough.

A witness said he saw Tomlinson in Hinde House Lane, Grimesthorpe, on September 11, 2010. He said Tomlinson was carrying a TV close to the scene of a burglary where a TV, digital camera and mobile phone were stolen. Lawyers argued video identification evidence should not have been allowed into the trial, but their complaints were rejected by appeal judges Lord Justice Pill, Mr Justice Owen and Mr Justice Kenneth Parker.
