In his letter of May 11, Paul Birch claims “there is no pavement, it is a road”.
1) It is not a public roadway, it is, in fact, a private entrance that crosses over a public right of way that was there long before the car park was built.
2) The Highway Code states that a pedestrian already crossing any road onto which another road turns has right of way if they have already started to cross and that the vehicle should give way, i.e. wait.
If a pedestrian was to be harmed in such circumstances it is very likely that the law would be on their side and a claim against the driver could be made.
Mr Birch, selfish vehicle drivers do not always have right of way, and never to enter a private property.
