A TAXI driver has been fined after being caught lighting up in his black cab.
Pedro Carrillo, aged 60, of Vernon Road, Brampton, Chesterfield, was spotted smoking inside a hackney carriage on Derby Road, near the junction with Storforth Lane, Birdholme, Chesterfield.
Magistrates were told it is an offence under the Health Act 2006 if a person smokes in a vehicle used by the public.
The council had initially offered Carrillo a £50 fixed penalty notice instead of prosecution but he did not pay the fine, which would have been reduced to £30 if paid within 15 days.
Carrillo wrote to the court pleading guilty, adding he was sorry for not paying the fine but had been ill. He was fined £117 and ordered to pay costs of £100 to the council, plus a victim surcharge of £15.
