Police cell dash to save injured man

An ATTACK victim nearly died in a police cell after being arrested, a court heard.

Dean Hutton, aged 22, who suffered serious head injuries after being allegedly assaulted by three men, spent more than 11 hours in a cell before a police surgeon was called and he was rushed to hospital for emergency surgery.

He survived but suffered brain damage and could not give evidence in court.

Mr Hutton was arrested for missing a court appointment after police were called to a disturbance in which he was involved in Masbrough. He was checked by paramedics and taken to Rotherham's Main Street police station, Sheffield Crown Court heard.

Prosecutor Mike Smith said 11 hours later he was found "very unwell" and taken to Sheffield's Royal Hallamshire Hospital. He had a fractured skull and suffered bleeding on the brain.

The court heard officers checked on him regularly and when he became seriously ill the police surgeon was called.

Mr Smith said: "The main injury to his head was caused by the pole but other blows would have contributed."

Brett Garbutt, 22, his brother James Garbutt, 26, and Karl Charnock, 28, all from Rotherham, deny grievous bodily harm with intent and an alternative charge of GBH.

It is alleged Garbutt struck Mr Hutton with the pole at least once on the head and then his brother James and Charnock waded in.

Garbutt said he used the pole in self-defence but another two men kicked and stamped on him.

Garbutt and Charnock deny any part in the attack.

The trial continues.
