A South Yorkshire driver was caught texting for 450 metres while driving at 40mph.
A police officer in an unmarked car spotted the motorist in action as he was driving along Ridgeway Road, Sheffield.
When he was pulled over the driver said he did not realise it was an offence because he was not talking on the phone.
New laws came into force this week, with harsher penalties for those who break the law.
Those caught using a mobile phone while driving will be automatically issued with six penalty points and a £200 fine.
New drivers with less than two years' experience will become provisional licence holders again.
Officers in marked and unmarked are patrolling the roads looking for offenders.
