SHEFFIELD United will attempt to block West Ham's efforts to win a new hearing over the Carlos Tevez Affair at the Court of Arbitration for Sport as the London club's battle to overturn Bramall Lane's landmark legal victory enters a critical phase.
Officials in Lausanne have set United a 24 hour deadline to respond to West Ham's submission that CAS should intervene after an independent tribunal ruled they are liable for compensation after breaching transfer regulations when they signed the Argentina international in 2006.

United, who were relegated in controversial circumstances at the end of the 2006/07 campaign, are currently in the process of finalising their claim which could see them receive up to £50m from West Ham.

And, having consulted with their lawyers, United will tell CAS that they have no jurisdiction over what both they and the Football Association, whose guidelines governed the three man panel's investigation, believe was a private matter.

West Ham, like United, agreed that the decision of Lord Griffiths and his colleagues would be binding before entering into the process and the FA, despite insisting they played no part in the arbitration, are known to back Bramall Lane's stance.

However West Ham's approach to CAS is believed to focus on the fact that they have had no chance to appeal the ruling that Tevez, whose presence in their team contravened rules outlawing third party agreements, helped them win more than three points over the course of the campaign.

How can you say Tevez helped West Ham win more than three points over the course of the campaign. That is the most rediculous statement I have ever heard. His presence in the 'team' also had a negative factor, as West Ham spent the whole season at the bottom of the table. And West Ham would have stayed there had Sheffield not been so utterly useless in the last eleven games! West Ham's lawyers are simply fighting their corner, just like McBabes'. This saga will run and run. There may well be an out-of-court settlment, a gesture of goodwill, a few million maybe, but it will probably go to High Court, and that will cost both club owners millions in legal costs. Only the lawyers will win at the end.

How can West Ham be said to have agreed that the arbitration panel's decision should be binding?

As I understand it, West Ham did not want the matter to proceed to arbitration, for obvious reasons, but were given no choice in the matter by the FA. Hence the FA rule to the effect that by consenting to the arbitration, both parties are deemed to have irrevocably waived any right of appeal or challenge, does not apply, since "consent" under duress is not true consent.

So WetSham are whiter than white are they?

I see that they have broken Premier League rules again — by letting an unregistered doctor treat players!

It is against Premier League and GMC rules to practise medicine in the UK without clearance from the governing body.

But because it's WetSham I'm sure it'll be OK!

to be honest I'd love it if west ham was put out of business and if that meant we didnt recieve anything, then so be it!

although I doubt it will happen, given that the icelandic owner has his fingers in more than one pie, and not just the bank that has been nationalised

Totally agree with at least ONE thing said above....the lawyers / solicitors are laughing all the way to the bank !.

However, West Ham WILL NOT WIN the Sheff Utd battle.

They are a club in crisis. No shirt sponsor, Ljunberg taken a few million off them, their sugar daddy in limbo and a multi million payout to Sheff Utd, inevitable.

And KETTERING FAN, your argument is so worn out and tatty. This argument has NOTHING to do with United's poor end of season form. It's about breaking rules. West Ham broke them, Sheffield United DIDN'T.

Had we 'borrowed' Ronaldo from Man Utd for the one game v Wigan, and won, and West Ham had been relegated, would there have been any fuss ????.

I rest my case.

Kettering Fan, I suggest you check out a few facts first.

1. BOTH clubs signed an agreement that they would adhere to the arbitrations findings, including if SUFC lost it's case, West Ham clearly has no honour. West Ham have been found guilty of cheating and should face upto the concequences. I belive at the moment they are reaping what they sowed (lost sponsor, lost players, manager leaving, financial backer in trouble and now a big pay out to SUFC. Cheats will never prosper in the long run.
